DECISION
The claimant was demoted from City Engineer with supervisory and administrative responsibility, to City Engineer with his scope of supervisory and administrative responsibility reduced. The claimant’s pay was reduced and his job classification of City Engineer was retained with a demotion to a step 6, with no eligibility for a progressive step increase. The claimant could not be the Engineer in responsible charge, therefore he could not perform his work as a licensed professional engineer without going against his ethics and possibly violating the law and jeopardizing his Engineer License. The claimant explored some avenues to try and alleviate the situation, but at the time he was told he was no longer the City Engineer, but would be the Design Engineer, he did not feel he could continue in either position because both required him to stamp or approve projects he was not responsible for. Although the claimant’s resignation states he was retiring, he did not want to do so, but felt that his employer left him no choice but to quit. The claimant would have continued to work had the circumstances been different. The claimant has established he quit his job when it became unsuitable to him after his job tasks, working conditions, and the work contract changed.
The evidence in the record establishes that the claimant quit with good cause in connection with the employment. The claimant is eligible for benefits effective 09-01-96.
