Because I have been denied any supervisory or administrative activities, and am not overseeing this project, and because I have been instructed by my attorney not to engage in any activity which may jeopardize my license with the State of Idaho, or compromise my professional integrity, I hereby:

DISCLAIMER LETTER

Subject: Burns Addition Division No. 1

The following is an explanation why I decline to sign the plat at this time:

1. The subject property was discussed at the Grievance Hearing dated April 26, 1996, by Steve Anderson and Ed Turner regarding the design of the curb and gutter (horizontal and vertical alignment), storm drainage, street cross-section, crown, etc.

2. Ed Turner was given instructions by Steve Anderson to design the new curb and gutter along 19th street and along Rollandet Ave. adjacent to the subject property. The join line to the asphalt paving along 19th Street and Rollandet was to be kept at a minimum width of approximately 3' to 5'.

3. As mentioned in the Grievance Hearing, the design that Ed Turner provided apparently was not acceptable and Steve Anderson said he will take care of the project.

4. The project has been completed with new curb and gutter, sidewalk, asphalt paving. The asphalt paving, base, sub-base was replaced on 19th Street. Asphalt paving along Rollandet was also replaced.

5. Who engineered the design and construction for this project? What is the horizontal and vertical alignment of the new curb and gutter?

6. How does the new horizontal alignment of the curb and gutter and sidewalk compare with the horizontal alignment of the plat?

Please provide the information needed above so that the plat and the "As Constructed" improvement drawings can be reviewed simultaneously.
